Governments in Saskatchewan and Alberta are intervening in a court case concerning the Canadian federal government’s decision to declare single-use plastics as “toxic substances” and ban them by 2025. The Responsible Plastic Use Coalition, made up of plastic industry manufacturers, including Dow Chemicals Canada, Imperial Oil, and Nova Chemicals, brought the case to Federal Court in Toronto from March 7 to 9, and a future decision will be issued. The single-use plastic ban began effective Dec. 20, 2022, and by December 2023, it will be illegal to sell these plastic products in Canada. The Saskatchewan and Alberta governments submitted arguments to the court contesting the federal government’s constitutional power to pass the ban. Environmental groups, including Environmental Defence, Oceana Canada, and Animal Justice, support the federal government’s ban, while the Fraser Institute argued that the federal government’s ban on single-use plastic would increase, rather than diminish waste in the country.
